We, fourreal GmbH (hereinafter “fourreal”), have a legal obligation to protect your data and we take this obligation very seriously. Please take the time to read our Privacy Policy carefully to find out why we collect your data and how we process it in connection with our business activities, the operation of our website, marketing activities and recruitment processes. fourreal, as the operator of this website, endeavours to carefully check the content provided and to the best of its knowledge and belief to present it completely and correctly and to keep it up-to-date.

We therefore process your data exclusively on the basis of the applicable statutory provisions, namely the national Data Protection Act (DSG), the General Data Protection Regulation (GDPR) and the Telecommunications Act 2003 (TKG 2003).

2. PERSONAL DATA

Personal data within the meaning of data protection law is all data containing information about personal or factual circumstances, such as name, address, e-mail address, telephone number, date of birth, age, sex, national insurance number, video recordings, photographs and voice recordings of individuals. It may also include sensitive data, such as health data or data relating to criminal proceedings.

To improve the quality of the information we offer, the following data is collected, stored and evaluated on our website when you visit our website: Browser type, operating system, country, date, time, length of time spent on the site, IP address, pages visited, including entrance and exit pages. This data will not be used to personally identify the visitor of this website. For data processing we use contract processors. Your data will also be processed at least in part outside the EU or the EEA, namely in the USA. The adequate level of protection is based on an adequacy decision of the European Commission pursuant to Art. 45 GDPR and on the privacy policies of the contract processors (see point 5. Data Recipients). The web server is located in Frankfurt am Main in Germany (the headquarters of the provider – Digital Ocean in the USA).

If, in addition, personal data (e.g. name, address or e-mail addresses in connection with the sending of our newsletter) is collected on our pages, this is done on the basis of information that you have provided voluntarily. We will not pass on this data to third parties without your explicit consent.

3. PURPOSE OF DATA PROCESSING

We process your data for the following purposes:

1. a) Processing and transfer of personal data within the framework of business transactions and activities undertaken prior to entering into a contract in connection with (potential) business transactions.
2. b) Operation and optimisation of our website
3. c) fourreal marketing: Sending alerts and information about current projects, in particular when sales and marketing activities are launched for projects, invitations to fourreal events and the organisation of these events, sending of event-related congratulations by fourreal.
4. d) Evaluation of the professional and personal skills of applicants and the filling of vacancies

4. LAWFUL BASIS FOR DATA PROCESSING

Data processing (a) within the scope of our business activities is carried out on the lawful basis of performance of the contract or of steps taken prior to entering into a contract with the respective (potential) business partners in accordance with Art 6 (1) b GDPR and the lawful basis of consent in accordance with Art 6 (1) a GDPR, because processing is necessary for compliance with a legal obligation in accordance with Art 6 (1) c GDPR and because processing is necessary for the performance of a task carried out in the public interest in accordance with Art 6 (1) e GDPR, namely to report data to Statistik Austria AG, and for the establishment, exercise or defence of legal claims in accordance with Art 9 (2) f GDPR.

If you are already a fourreal business partner or wish to become one, i.e. if you have an existing contract or wish to conclude one, you are obliged – on the basis of the contract with fourreal – to provide certain personal data that is necessary for the purposes of the business transaction. Failure to provide such data would result in fourreal being unable to enter into any business with you.

Data processing (b) for the purpose of operating and optimising our website is carried out on the lawful basis of legitimate interests in accordance with Art 6 (1) f GDPR, namely the legitimate interest of fourreal in operating and optimising the website and marketing, whereby, with the exception of registrations for the fourreal newsletter and for fourreal events, the IP address is not captured in full and therefore cannot be attributed to a particular individual during the analysis of the website usage. (For more information on the collection of data and the software used, please refer to the Cookies section of this Privacy Policy and the “Privacy Policy for Google Analytics”).

Data processing (c) for fourreal marketing purposes is carried out on the lawful basis of consent in accordance with Art 6 (1) a GDPR and on the lawful basis of the legitimate interest in accordance with Art 6 (1) f GDPR, namely the interest of fourreal in marketing activities and supplying information about relevant updates regarding fourreal projects.

Data processing (d) within the scope of application processes is carried out on the lawful basis of consent in accordance with the Art 6 (1) a GDPR, steps taken prior to entering into a contract in accordance with Art 6 (1) b GDPR and on the lawful basis of the legitimate interest in accordance with Art 6 (1) f GDPR, namely the interest in examining candidates for suitability for the specific position within the company. It is necessary to process your data for the purpose of the application process. If you do not make your data available, we will not be able to process your application.

5. DATA RECIPIENTS

Personal data is passed on to the following persons:

1. a) Within the scope of business activities: Agents, lawyers, architects, specialist planners, third parties who are involved with the performance of our contracts (e.g. notaries), insurance companies, banks, tax consultants, accountants and regional health insurance funds.

6. TRANSFER OF DATA TO A THIRD COUNTRY

It may be necessary in the course of ongoing business relations and activities undertaken prior to entering into a contract (potential business partners) to transfer personal data to other companies outside Austria and outside the European Economic Area. Some of these countries do not offer the same level of data protection as within the European Union.

In cases where fourreal transfers personal data, appropriate safeguards for the transfer of data will be put in place to ensure adequate protection. Upon request fourreal will supply a copy of the security measures.

7. DURATION OF DATA RETENTION

Personal data that is processed by us will only be stored by us until the purpose for which it is processed is fulfilled. Criteria for data retention are:

1. a) Within the scope of business activities: Insofar as corporate and tax law retention periods must be observed, certain data may be stored for a period of up to twenty-two years. Additional criteria for data retention are obligations under commercial law, the fulfilment of evidence requirements in connection with the prevention of money laundering and the financing of terrorism and the length of the limitation period for legal claims (can be up to 40 years depending on the legal basis).
2. b) Operation and optimisation of our website: To improve the quality of the information we offer, the following data is collected, stored and evaluated on our website when you visit our website: Browser type, operating system, country, date, time, length of time spent on the site, IP address, pages visited, including entrance and exit pages. This data is not used to personally identify the user of this website. Personal data is processed when registering for fourreal events and the newsletter (for details of how long this data is stored please see Point 7.c. below).
3. c) fourreal marketing: Until we receive notice that this consent has been withdrawn. The data you provide when registering for an event is deleted one month after the date of the event.
4. d) Application processes: Data is stored for up to seven months after completion of the application process if no contractual relationship is established. If you consent to us keeping your details on file, your data will be stored until we receive notice that this consent has been withdrawn (however, for no longer than three years at most).

8. YOUR RIGHTS

As a data subject within the meaning of data protection legislation, you have in particular the following rights:

• The right to information about the processing of your personal data;
• The right to have your personal data corrected or deleted or to restrict processing;
• The right to object to processing
• The right to data portability.

Should there be any changes to your personal data, please inform us accordingly. If you are of the opinion that the processing of your data breaches data protection law or that your data protection rights have otherwise been violated, you may lodge a complaint with the Data Protection Authority.

If the data processing is based on your consent, you may withdraw your consent to the processing of your data at any time by writing (e-mail suffices) to office@fourreal.eu. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

9. LINKS TO OTHER WEBSITES

Our website also contains links to other websites. However, the Privacy Policy set out here does not apply to these websites. We therefore request that you visit these websites directly in order to obtain data protection information for the respective websites. fourreal cannot be held liable for measures adopted by these websites or for the content of these websites.

10. WEB SERVER DATA

Server Data – Visiting the Website

We collect and use personal data to the extent necessary to provide functional websites and our content and services. We use your personal data to provide you with the information, products and services we offer, to answer your questions and to operate and improve our websites and applications.
For technical reasons, in particular to ensure a secure and stable Internet presence, data is transferred to us or to our web space provider via your Internet browser. This data is used to process the type and version of your web browser, the operating system you use, the website of our Internet presence that you visit, the date and time you visit our website as well as the IP address of the Internet connection from which our Internet presence is accessed.

The data collected in this way will be temporarily stored, but not together with your other data. This data is stored on the legal basis of Art. 6 (1) f GDPR.

The data will be deleted again after authorised processing, provided that no further storage is required for security purposes or for use as evidence under applicable law. Otherwise, the data will be wholly or partially exempt from deletion until an incident has been conclusively resolved.

Protocols

The web server stores only anonymised data unless you register for the fourreal newsletter or fourreal events via our website. In this case, the personal data you enter as well as your IP address and the user agent will be saved.

We store the anonymised data for technical reasons as well as for the statistical evaluation and analysis of the use of our website in order to optimise our Internet presence.

For more information on the storage of personal data within the scope of fourreal marketing activities, please refer to “Newsletter” under Point 11 of this Privacy Policy. For more information on the duration of storage please refer to “Duration of Data Retention”, Point 7 c).

11. NEWSLETTER

You have the possibility to subscribe to our newsletter via our website and thereby receive electronic news about legal topics and events.

If you register for our newsletter via our website, we process your name, your e-mail address, the time of registration and your IP address. In addition, we store details of which newsletters we have sent you, if and when you opened or blocked them or marked them as spam, whether they could not be delivered temporarily or permanently, whether you subscribe or unsubscribe from the newsletter and which and how many links you click on in the newsletters. The processing of this data is covered by the consent given when registering for our newsletter. If you do not wish to provide this information, we ask you not to register for the newsletter.

You may cancel the receipt of the newsletter at any time using the link contained in the newsletter or by sending an e-mail to newsletter@fourreal.eu. You will then be unsubscribed from the newsletter and your data will then be deleted.

12. DATA SECURITY AND CYBER SECURITY

Appropriate organisational and technical precautions have been put in place to protect your personal data. Your data is hosted by providers which are located in Austria or in a country which complies with the “EU-U.S. and Swiss-U.S. Privacy” Shield frameworks (Digital Ocean USA). Both fourreal and the providers use technical and organisational security measures to protect the data collected from manipulation, loss, destruction or access by unauthorised persons. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information that you disclose to us via the Internet may be viewed and used by other persons.

We would like to point out that transferring data over the Internet (e.g. communication by e-mail) may have security vulnerabilities. Complete protection of data from access by third parties is not possible.

Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transfer not caused by us and/or unauthorised access by third parties (hacking attacks on e-mail accounts or telephone, interception of faxes).

13. COOKIES

Cookies help make our services more user-friendly, effective and secure. Cookies are little text files that are stored on your computer and saved to your browser.
